The Active Socks website is created by Weaveweb and controlled by Active Socks Pty Ltd (ABN 28 437 522 871) in the State of Victoria, Australia. As such, the laws of the Commonwealth of Australia and, and where applicable, the State of Victoria, will govern these Terms and Conditions. By using this site you submit to the jurisdiction of the courts of Victoria and Australia and agree that any legal action will only be commenced in these forums.
From time to time we may need to modify the Terms and Conditions, other policies, or the content of the Site, without notice so please check back periodically as all updates will be published at this site. If you do not agree to any change, then you must immediately stop using the Site. Any changes made to the Site after you have placed an order will not affect that order however, unless we are required to make the change by law.

Material owned by Active Socks Pty Ltd is subject to copyright and may not be used, copied, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever unless written permission is obtained from Active Socks Pty Ltd prior to use of the material.
Any reproduction or redistribution of the above listed content is prohibited. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited. However, you are permitted to make one copy for the purposes of viewing content for your own personal use.
In order to make purchases through the Active Socks website, you will be requested to provide your personal details. In particular, Customers must provide their full name, preferred contact phone number, e-mail address, payment details and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details. By entering your payment details you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided.
The Active Socks website is available only to individuals who meet the terms of eligibility. Individuals must have been issued a valid credit card by a bank acceptable to Active Socks, applications must be acceptable to Active Socks and who have authorised Active Socks to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise.
We reserve the right to only accept orders from buyers aged 18 years and over.
Prices shown on the Active Socks website are in Australian Dollars (AUD) and are inclusive of GST. Prices are subject to change.
How to place an order
Each Active Socks product detail page contains the option Add to Cart. As you shop, you can add as many items to your shopping basket as you wish. After adding the last item, review your Shopping Bag. This page will give you a break down of the product(s) you have selected to buy, along with the price and quantity for each. Here you can edit your purchases – deleting items, adding promotion codes or changing quantities as needed, calculate the cost of shipping or go to Checkout.
Incorrect Shipping Address
Your order will be shipped to the address that you provide when you place your order. It's your responsibility to supply an accurate Shipping Address including the correct Suburb, State and Postcode. Active Socks does not accept responsibility for orders which have been shipped to an incorrect address that you have provided.
It's important to include the correct postcode because many suburb names are duplicated around the country. For example, there are 6 Richmonds around Australia, one in Victoria, Tasmania, New South Wales, South Australia and two in Queensland. Without the corresponding Postcode for a Suburb and State, it's easy for Australia Post to misdirect your parcel.
If you've made a mistake and provided the wrong postcode or suburb, your parcel will be redirected to the AusPost Mail Redistribution Centre where, after an investigation, the item may be sent back to us. The Mail Redistribution Centre has special authority to open mail that arrives there. Australia Post does not agree to requests for undeliverable articles to be returned within a certain time - this can take several weeks. When your order is returned to us we will contact you to for the correct Shipping Address. Please note that an additional postage fee may be charged.
If after you place your order you realise that you've made a mistake with the Shipping Address please call us immediately on +61 3 9384 6933 or send us an email to email@example.com. As soon as you contact us we will place your order “On Hold” to stop further processing (provided that is hasn’t been lodged with AusPost as yet) so that the Shipping Address can be corrected.
If a parcel is returned to us as UNCLAIMED, further freight charges will be payable for re-despatch. Please ensure that you enter the correct delivery address as parcels which are returned to us as UNDELIVERABLE will incur a re-send fee. Parcel charges for the original despatch are not refundable. Methods of Payment
Active Socks conveniently offers both online and offline payment methods.
By Credit Card
Choose "CREDIT CARD" at the Shopping Checkout and process your credit card details. All credit card transactions are handled by eWAY online payment services. Your credit card number is sent by an encrypted connection to your bank.
By EFT Direct Deposit to:
Choose "DIRECT DEPOSIT" at the Shopping Checkout. Your Order Number and the bank details for the EFT Direct Deposit will be displayed at the completion of the checkout process.

Acceptance of your order
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is not an acceptance of your order, just a confirmation that we have received it.
Unless you cancel your order, acceptance of your order and completion of the contract between you and Active Socks will be completed when we email you to confirm the goods have been despatched and have been handed over to the designated carrier. The sale contract is therefore concluded in Victoria, Australia. We reserve the right not to accept your order in the event that we are unable to obtain authorisation for payment, that the item ordered is out of stock or that you do not meet the eligibility criteria set out within the Terms and Conditions.
Active Socks reserves the right to refuse to process or refuse service to anyone at any time at our sole discretion.
Out Of Stock Items
An item that is out of stock that you attempt to add to your cart will clearly display an “Out of Stock” message next to the item. In the case where an error is made you will be contacted if the item you ordered is out of stock. At this point you can either choose to substitute for another item in stock, remove it from your order, cancel your order or place your order temporarily on hold until your item is in stock again.

Orders that are received prior to 1.30pm are despatched the same day. Orders received over weekends, Bank Holidays and after 1.30pm Monday - Friday will be despatched the next working day. There is no despatch or delivery on Bank Holidays, Saturdays and Sundays.
After placing your order online, you'll receive an email confirmation containing your order details. If any of the items you have ordered are out of stock we will contact you either by phone (or by email) to discuss your options. You can either choose to substitute for another item in stock, remove it from your order, cancel your order or place the item on backorder until it is in stock again. We will keep you informed of any changes and give you the option to cancel the order and receive a full refund of any monies paid.
General Shipping Information
Orders are packed for despatch the same day payment is received. Orders that are received prior to 12.30pm are despatched the same day. Parcels will be delivered by Australia Post according to your preferred method of delivery either Standard Post or Express Post.
Standard Post: Orders are usually delivered within 3-4 business days to metro areas - regional areas may take a little longer
Express Post: Orders are delivered within 1-2 business days to addresses located within the Express Post Network
Free Shipping: Orders valued over $200 will be eligible for Free Shipping within Australia. Parcels despatched using this shipping option are shipped by Standard Post and are delivered within 4-7 business days (depending on the destination).
When your order is lodged with Australia Post eParcel you'll receive notifications from Australia Post to track when:
- your parcel is lodged and despatched
- your parcel arrives at your local Postal Delivery Facility
- when your parcel is loaded onto the van for delivery
Please allow 12-24 hrs for Australia Post to scan your parcel before it appears on their tracking site. Once lodged with eParcel, orders are generally received within the regular delivery timeframes as outlined by Australia Post.
If you are not around to accept delivery: A Collection Card will be left in your mailbox with instructions on how you can collect the parcel from your nearest post office. You will have 5 business days to pick up your parcel.
We do not ship on Saturdays, Sundays, or on Public Holidays. While we will do all we can to ensure your order is delivered on time, Active Socks cannot be held responsible for conditions beyond our control such as severe weather, service interruptions, etc.
Although every effort is made to ship your Order according to the estimated delivery times provided, expected delivery times can vary to Rural/Regional areas where delivery may take longer than indicated. If your parcel has not arrived after the estimated delivery time, please contact us.
Please ensure that you enter the correct delivery address as parcels which are returned to us as UNDELIVERABLE or UNCLAIMED will incur a re-send fee. Parcel charges for the original despatch are not refundable. Please be aware that customs or import duties may be applied once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you may want to contact your local customs office for further information.
Returns & Exchange Policy

In the unlikely event that you receive a damaged or defective item or if we have shipped an incorrect item, we will happily exchange the item and despatch the correct item free of charge.
If you need to return your order, it should be packaged securely in the same packaging in which you received it. We recommend that you register the package and obtain a tracking number for delivery confirmation. If you no longer have the original packaging, it is your responsibility to ensure that the goods arrive with us in their original condition. We reserve the right to refuse a refund/exchange for damage caused by insufficient packaging.
For reasons of hygiene, we're unable to offer exchanges or refunds on any opened product. The Refund Policy does not apply to goods which have been worn or used, damaged after delivery, or if any attempt has been made to alter the product or if they have been dyed, bleached or shrunk. We expect that products will be returned as new, with tags and in the original packaging should they be unsuitable or an incorrect size.
Refunds are calculated on the purchase price of the goods returned to us. The refund amount is based on what was paid for the goods but not the delivery charge, except in cases where the entire order was faulty.
Exchanges will be processed within 2 working days from the date the returned goods are received. Postage charges will be applied for any exchanges at the standard rate.
All postage and insurance costs are to be paid by the buyer. We recommend that you return merchandise via Registered Post. You assume any risk of lost, stolen or damaged goods during transit and therefore recommend that you consider taking out Parcel Insurance with Australia Post. Active Socks will not be responsible for parcels that are lost or damaged in transit should you choose not to insure the merchandise.
By placing an order with Active Socks you agree to use the products only for their intended purpose. If you use the products for any other purpose you will assume full responsibility for any loss or damage arising out of this use.
In addition to the intellectual property rights mentioned above, "Content" is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on the Active Socks website. Active Socks tries to ensure that the information on this site is accurate and complete.
